By using this website, creating an account, placing an order, submitting payment, or otherwise communicating with us regarding a transaction, you agree to be bound by these Terms and Conditions.

Please read these Terms carefully before placing an order. Precious metals, bullion, and numismatic products are subject to market movement, limited availability, fraud screening, shipping requirements, and other conditions that may differ from ordinary consumer goods.

1. Eligibility and Website Use

You must be at least 18 years of age and legally able to enter into binding contracts to use this website or purchase products from Yellow Rock Coin & Bullion. By using this website, you represent that the information you provide is accurate, current, and complete.

You agree not to use this website for any unlawful purpose, fraudulent activity, unauthorized resale scheme, attempted market manipulation, payment fraud, identity misrepresentation, or activity that interferes with the operation, security, or integrity of the website.

2. Account Information and Customer Responsibility

Customers are responsible for maintaining accurate account, billing, shipping, and contact information. Yellow Rock may rely on the information submitted during checkout, by email, by phone, or through any customer account portal.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. If you believe your account has been accessed without authorization, you must notify us promptly.

3. Product Information, Images, and Availability

Yellow Rock makes reasonable efforts to display accurate product titles, descriptions, images, specifications, pricing, and availability. However, product images may be representative examples and may not depict the exact item received unless the listing specifically states that the photographed item is the exact product being sold.

Bullion, numismatic coins, certified coins, government mint products, bars, rounds, and related items may be subject to limited supply. Product availability is not guaranteed until an order is accepted, payment is verified, and inventory is allocated.

We reserve the right to correct typographical errors, pricing errors, product description errors, image errors, availability errors, or other inaccuracies at any time, including after an order has been submitted. If an error affects an order, we may cancel the order, request corrected payment, or offer the customer an opportunity to proceed under corrected terms.

4. Pricing, Market Movement, and Locked Orders

Precious metals prices can move rapidly. Product prices may be based on spot market values, dealer premiums, product scarcity, sourcing cost, payment method, shipping cost, and other business factors.

Unless otherwise stated, the price displayed at checkout is the price available at that moment only. An order is not final merely because it has been submitted through the website. Yellow Rock may review each order for pricing accuracy, payment approval, inventory availability, fraud risk, compliance concerns, and other operational factors before accepting the order.

Once Yellow Rock accepts an order and the price is locked, the customer is bound to complete the transaction. Because bullion and numismatic products fluctuate in value, confirmed orders may not be cancelled simply because market prices changed after the order was placed.

5. Right to Refuse, Cancel, or Limit Orders

Yellow Rock reserves the right, in its sole discretion, to refuse, cancel, limit, or hold any order for any lawful reason, including but not limited to:

  • Suspected fraud or unauthorized payment activity
  • Incorrect pricing or product information
  • Inventory shortages or supplier cancellation
  • Payment failure, reversal, dispute, or high-risk payment review
  • Inconsistent billing, shipping, identity, or contact information
  • Unusual order size, order pattern, or resale concern
  • Compliance, regulatory, sanctions, or anti-money-laundering concerns
  • Failure to provide requested verification information

If an order is cancelled after payment has been received, Yellow Rock will issue any refund due according to the original payment method where reasonably possible, subject to applicable market loss, cancellation, processing, or return terms described in these Terms.

6. Payment Methods

Yellow Rock may accept one or more payment methods, including ACH, bank wire, paper check, certified funds, debit card, credit card, or other approved payment options. Available payment methods may vary based on order value, product type, customer history, fraud screening, processor rules, or internal policy.

Certain payment methods may require additional verification, delayed shipment, or cleared funds before products are released. Orders paid by ACH, check, or similar bank-based methods may be held until funds are fully confirmed and no longer subject to ordinary return or reversal risk.

Credit card orders may be subject to maximum order limits, enhanced fraud review, cardholder verification, processor approval, and additional restrictions. Yellow Rock may require high-value orders to be paid by ACH, bank wire, certified funds, or another approved non-card method.

7. Payment Method Pricing

Yellow Rock may display different prices or discounts based on payment method where permitted by applicable law, payment processor rules, and card network requirements. For example, an ACH, check, or bank wire price may differ from a credit card price due to processing costs and risk associated with each payment method.

Any displayed payment-method pricing is intended to be transparent before checkout. Customers are responsible for reviewing the selected payment method and total order amount before submitting an order.

8. Credit Card Limits and Review

Because precious metals transactions may involve high dollar values and low margins, credit card purchases may be limited by transaction amount, customer history, product category, or processor approval. Yellow Rock may require orders above a specified threshold to be completed by ACH, bank wire, or another approved payment method.

Submitting a credit card payment does not guarantee order acceptance. Yellow Rock may request a government-issued ID, cardholder confirmation, address verification, signed authorization, or other reasonable documentation before processing or shipping an order.

9. Sales Tax

Sales tax obligations vary by state, product type, order amount, and applicable law. Yellow Rock will collect sales tax where required. Customers are responsible for any taxes, duties, reporting obligations, or other charges that apply to their purchase.

If a customer claims a tax exemption, the customer must provide valid documentation before the order is processed as tax exempt. Yellow Rock is not responsible for retroactively applying exemptions that were not properly submitted before checkout.

10. Shipping, Insurance, and Delivery

Yellow Rock ships orders using secure packaging and carrier services appropriate for the value and nature of the products. Shipping methods, insurance requirements, delivery confirmation, and signature requirements may vary by order.

Orders may be delayed until payment is fully verified, funds have cleared, identity has been confirmed, and all fraud-screening requirements are satisfied. Shipping estimates are not guarantees.

Yellow Rock may require adult signature, direct signature, restricted delivery, or other delivery safeguards. Customers are responsible for providing a secure and accurate delivery address. We may refuse to ship to certain addresses, including freight forwarders, mail drops, hotels, temporary addresses, or addresses that cannot be verified.

11. Lost, Damaged, or Misdelivered Packages

Customers must inspect packages promptly upon delivery. If a package is lost, damaged, tampered with, misdelivered, or appears to have been opened before receipt, the customer must contact Yellow Rock as soon as possible and no later than 48 hours after delivery confirmation or discovery of the issue.

Customers must retain all packaging materials, labels, envelopes, boxes, photographs, and related evidence while a claim is under review. Failure to cooperate with carrier, insurer, payment processor, or law-enforcement inquiries may limit or void claim eligibility.

Yellow Rock will work in good faith to assist with valid shipping claims, but we are not responsible for delays or claim denials caused by inaccurate customer information, missed delivery attempts, unsigned packages, failure to preserve evidence, or failure to follow carrier claim procedures.

12. Returns and Exchanges

Due to the nature of precious metals, bullion, numismatic coins, and market-sensitive products, all sales are generally considered final once an order is accepted and the price is locked. Returns or exchanges are accepted only with prior written authorization from Yellow Rock.

If a return is approved, the customer must follow all return instructions provided by Yellow Rock. Returned products must be received in the same condition as delivered, including all original packaging, certificates, assay cards, capsules, holders, labels, seals, documentation, and accessories. Items that are damaged, altered, opened, removed from original sealed packaging, mishandled, or otherwise changed may be rejected or subject to a reduced refund.

Shipping charges, insurance costs, processing fees, payment fees, and other non-product charges are generally non-refundable unless required by law or unless Yellow Rock determines that an error occurred on our part.

13. Market Loss Policy

Because precious metals prices fluctuate, a customer who cancels, refuses delivery, fails to pay, returns an order without authorization, initiates an improper chargeback, or otherwise fails to complete a confirmed transaction may be responsible for any market loss incurred by Yellow Rock.

Market loss may be calculated based on the difference between the locked order price and the market value or resale value of the product at the time the transaction is cancelled, reversed, returned, or otherwise not completed. If the market moves in Yellow Rock’s favor, the customer is not entitled to any market gain.

Yellow Rock may deduct market loss, shipping, insurance, processing costs, collection costs, chargeback fees, and related expenses from any refund otherwise due, to the extent permitted by law.

14. Chargebacks, Payment Disputes, and Collection Rights

Customers agree to contact Yellow Rock directly to resolve any order issue before initiating a chargeback, bank dispute, payment reversal, or claim with a payment provider.

Improper chargebacks or payment disputes involving confirmed precious metals orders may result in cancellation of account privileges, collection activity, recovery of market loss, recovery of fees, and refusal of future orders.

Yellow Rock reserves the right to submit order records, shipment records, identity verification records, communications, delivery confirmations, photographs, payment records, and other relevant documentation to banks, card networks, processors, insurers, carriers, law enforcement, or collection agencies as needed to protect the business and resolve disputes.

15. Fraud Prevention, Identity Verification, and Compliance

Yellow Rock may use fraud-screening tools, identity verification procedures, payment review, manual review, address verification, and other safeguards to protect customers and the business.

We may request additional information before accepting, processing, or shipping an order. Requested information may include proof of identity, proof of address, cardholder verification, business documentation, source-of-funds clarification, or other reasonable documentation.

Yellow Rock reserves the right to cancel, hold, or report transactions that appear suspicious, unlawful, inconsistent, high risk, or non-compliant with applicable laws, regulations, sanctions rules, payment processor requirements, or internal risk policies.

16. Buybacks, Trade-Ins, and Sell-to-Us Transactions

Any buyback, trade-in, or sell-to-us transaction is subject to separate confirmation by Yellow Rock. Quotes may be based on market conditions, product type, condition, authenticity, assay results, certification, demand, and other factors.

No buyback price is final until the product has been received, inspected, authenticated, and accepted by Yellow Rock. We reserve the right to reject products that are counterfeit, altered, damaged, misdescribed, incomplete, or otherwise not acceptable.

17. No Investment, Tax, or Legal Advice

Information provided on this website, in product descriptions, by email, by phone, or through customer service is for general informational and commercial purposes only. Yellow Rock does not provide investment, financial, tax, retirement, legal, or accounting advice.

Precious metals and numismatic products can rise or fall in value. Customers are responsible for making their own purchasing decisions and should consult qualified professionals regarding investment, tax, legal, retirement, or estate-planning matters.

18. Authenticity and Product Condition

Yellow Rock seeks to offer genuine products from reputable sources. Product condition, grading, certification, packaging, and mint documentation will be described as accurately as reasonably possible.

For certified coins, grading opinions are issued by third-party grading services and are not guaranteed by Yellow Rock beyond the information provided with the product. Market value may vary based on condition, demand, grading standards, certification, eye appeal, mintage, and other factors.

19. Website Content and Intellectual Property

All website content, including text, images, logos, graphics, product descriptions, layout, design, and other materials, is owned by or licensed to Yellow Rock unless otherwise stated. Customers may use the website for personal shopping and informational purposes only.

You may not copy, reproduce, distribute, scrape, modify, republish, or commercially exploit website content without prior written permission from Yellow Rock.

20. Third-Party Links and Services

This website may include links to third-party services, payment processors, shipping carriers, marketplaces, authentication providers, manufacturers, or informational resources. Yellow Rock is not responsible for third-party websites, policies, availability, security, content, or business practices.

21. Limitation of Liability

To the fullest extent permitted by law, Yellow Rock and its owners, managers, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from website use, order delays, market movement, product availability, payment processing, shipping issues, third-party services, or customer purchasing decisions.

Yellow Rock’s liability for any claim related to a product purchase will not exceed the amount actually paid by the customer for the product giving rise to the claim, except where prohibited by law.

22. Indemnification

You agree to indemnify, defend, and hold harmless Yellow Rock Coin & Bullion LLC and its owners, managers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the website, breach of these Terms, fraudulent activity, violation of law, payment dispute, or infringement of another party’s rights.

24. Arbitration Agreement, Class Action Waiver, and Waiver of Jury Trial

To the fullest extent permitted by applicable law, you and Yellow Rock agree that certain disputes will be resolved through binding individual arbitration rather than in court. This means that you and Yellow Rock each waive the right to a jury trial and waive the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding, except where such waiver is prohibited by law.

This arbitration agreement is intended to provide a more efficient and cost-effective method of resolving disputes and is not intended to delay or prevent either party from pursuing a valid claim.

Claims Covered

Except for the exclusions listed below, this section applies to any dispute, claim, controversy, demand, or cause of action arising out of or relating to:

  • These Terms and Conditions
  • Use of the website
  • Any purchase, order, payment, shipment, return, cancellation, chargeback, or market loss
  • Any sell-to-us, buyback, trade-in, or related transaction
  • Communications with Yellow Rock
  • Privacy, data security, account access, fraud review, or identity verification
  • The validity, enforceability, interpretation, or scope of this arbitration agreement

These covered disputes are referred to in this section as “Claims.”

Claims Not Covered

This arbitration agreement does not prevent either party from:

  • Bringing an individual claim in small claims court if the claim qualifies and remains only in small claims court
  • Seeking temporary, preliminary, or emergency relief in court to protect intellectual property, confidential information, account security, payment rights, merchandise, or evidence
  • Reporting suspected fraud, theft, payment abuse, identity misuse, or unlawful conduct to law enforcement, financial institutions, payment processors, carriers, insurers, or regulators
  • Pursuing collection activity or recovery of merchandise where permitted by law

Informal Resolution Required First

Before either party starts arbitration or court proceedings, the party asserting a Claim must first send written notice describing the dispute and the requested relief. Customers must send notice to Yellow Rock at the contact information listed in these Terms. Yellow Rock may send notice to the billing address, shipping address, email address, or other contact information associated with the customer’s account or order.

The parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days after notice is received. If the dispute is not resolved during that period, either party may proceed with arbitration or, if applicable, an excluded court proceeding.

Arbitration Procedure

Unless the parties agree otherwise, arbitration will be administered by a nationally recognized arbitration provider such as JAMS or the American Arbitration Association under the provider’s applicable consumer or commercial arbitration rules then in effect. The arbitration will be conducted before a single neutral arbitrator.

The arbitrator may award any relief available in court on an individual basis, subject to these Terms and applicable law. The arbitrator may not conduct a class arbitration, consolidated arbitration, representative arbitration, or proceeding involving claims of more than one customer unless both parties expressly agree in writing.

The Federal Arbitration Act, 9 U.S.C. Section 1 et seq., governs the interpretation and enforcement of this arbitration agreement to the fullest extent permitted by law.

Unless applicable law requires otherwise, any arbitration will take place in the State of Georgia, in the county where Yellow Rock maintains its principal business office, or by telephone, video conference, or written submissions if permitted by the arbitration provider and agreed by the parties or ordered by the arbitrator.

Class Action and Representative Action Waiver

To the fullest extent permitted by law, you and Yellow Rock agree that each party may bring Claims against the other only in an individual capacity. You and Yellow Rock waive the right to bring, join, participate in, or recover through any class action, class arbitration, collective action, consolidated action, representative action, or private attorney general action.

If this class action waiver is found unenforceable as to a particular Claim, then that Claim must proceed in court and not in arbitration, unless the parties agree otherwise.

Jury Trial Waiver

To the fullest extent permitted by law, you and Yellow Rock knowingly and voluntarily waive the right to trial by jury for any Claim that is not required to be arbitrated.

Arbitration Opt-Out

You may opt out of this arbitration agreement by sending written notice to Yellow Rock within 30 days after you first accept these Terms. The notice must include your full name, mailing address, email address, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms, including payment obligations, market loss obligations, fraud review rights, collection rights, limitation of liability, or governing law.

Confidentiality

To the extent permitted by law, arbitration proceedings, filings, evidence, testimony, settlement discussions, and awards will remain confidential, except as necessary to conduct the arbitration, confirm or challenge an award, comply with law, enforce rights, report fraud, or protect payment, shipping, insurance, or collection interests.

Survival

This arbitration agreement survives order completion, account closure, payment dispute, shipment, delivery, cancellation, return, termination of website use, and any other end of the customer relationship.

25. Statute of Limitations

To the fullest extent permitted by applicable law, any claim, action, demand, arbitration proceeding, or other legal proceeding arising out of or relating to a purchase, sale, payment, shipment, return, cancellation, chargeback, market loss, buyback, trade-in, or alleged breach of these Terms must be commenced within one year after the claim accrues.

Any other claim arising out of or relating to this website, these Terms, or the relationship between the customer and Yellow Rock must be commenced within two years after the claim accrues, unless a shorter or longer period is required by applicable law.

Any claim not brought within the applicable limitations period is permanently barred to the fullest extent permitted by law. This section applies whether the claim is brought in arbitration or in court and survives termination of the customer relationship.

26. Governing Law

These Terms and Conditions and any dispute, claim, order, transaction, payment issue, chargeback, return, market loss, shipment issue, website use issue, or other matter arising out of or relating to Yellow Rock, this website, or these Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, unless another jurisdiction is required by applicable law.

To the fullest extent permitted by law, any court proceeding that is not subject to arbitration must be brought exclusively in the state or federal courts located in the State of Georgia, in the county where Yellow Rock maintains its principal business office, unless applicable law requires a different venue. Customers consent to personal jurisdiction and venue in those Georgia courts for any such proceeding.

27. Dispute Resolution

Customers agree to first contact Yellow Rock in good faith to attempt to resolve any concern, claim, payment issue, shipping issue, or product dispute before pursuing a chargeback, legal claim, regulatory complaint, or other dispute process.

If a dispute cannot be resolved informally and is not required to be arbitrated, the parties agree that any claim will be handled in the appropriate state or federal court located in the State of Georgia, in the county where Yellow Rock maintains its principal business office, unless applicable law requires a different venue. Yellow Rock reserves all rights and remedies available under Georgia law, other applicable law, equity, contract, payment network rules, carrier rules, insurer rules, and collection procedures.

28. Changes to These Terms

Yellow Rock may update, revise, or replace these Terms and Conditions at any time. The updated version will be posted on this website with a revised “Last Updated” date. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.
